Sending a Notice
To be effective, a notice must be a written communication that includes substantially the following:
- a physical or electronic signature of the copyright owner, or a person authorised to act on their behalf;
- identification of the copyrighted work claimed to have been infringed;
- identification of the material claimed to be infringing, with enough detail for us to locate it — a direct URL is best;
- your name, address, telephone number, and email address;
- a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law;
- a statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner.
Notices that omit these elements may not be effective. Knowingly misrepresenting that material is infringing may make you liable for damages under 17 U.S.C. § 512(f).
What We Do on Receipt
We remove or disable access to the identified material expeditiously and record the action. Where the material was supplied by a user, we notify that user and pass on the notice.
Counter-Notice
If you believe material of yours was removed by mistake or misidentification, you may send a counter-notice to the agent above including:
- your physical or electronic signature;
- identification of the material and where it appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district in which you live (or, if outside the United States, the Western District of Kentucky), and that you will accept service of process from the person who sent the original notice.
We may restore the material in 10 to 14 business days after receiving a valid counter-notice, unless we are told the complaining party has filed an action seeking a court order.
Repeat Infringers
We terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
